If you are a non-UK national who is subject to immigration control, but have lived in the UK legally and continuously for a certain length of time, you may be able to apply for permission to settle in the UK permanently. This is known as Settlement or Indefinite Leave to Remain (ILR).


Qualifying for ILR can be done through various routes, most commonly where you are in the UK with permission as a partner, as a family member, certain workers, continuous and long-term lawful residence and those with ancestry ties. 

What are the Requirements for ILR / Settlement?

Some of the requirements you would need to satisfy in order to have a successful application are that:

 

  • You are already living in the UK; and
  • You have lived here legally and continuously for a certain length of time; and
  • You have no criminal convictions, or if you do, that these have been spent, and 
  • You can demonstrate a knowledge of language and life in the UK, (unless exempted). 

 

You can demonstrate your knowledge of language and UK life by passing the Life in the UK test, and either having a recognised qualification in English, or having a degree that was taught or researched in English, or being a national of an English-speaking country.


Financial Requirements for Indefinite Leave to Remain

Depending on the route you are on (e.g. 5 year as a spouse of a settled person in the UK), you will also either need to meet the minimum income threshold or prove you have sufficient funds to house and support you and any dependants.

What are the Fees?

The current fee for Indefinite Leave to Remain is £2,885. 


You will also need to take the Life in the UK Test which is £50, and if you need to take an English Language Test that will be another £150 to factor in your application.



How Long Does it take to get a Decision?

The Home Office advise that you should get a decision within 6 months.  It can take longer than this if your case is complex and the home office require further information or verifying of your documents.


You also have the option to speed up your application as quickly as 1 working day by paying extra for the Super Priority Service.


Further Leave to Remain (FLR)

If you do not yet qualify for ILR, you may be able to extend your existing visa.

This is known as Further Leave to Remain. 


These could be for those currently on spouse/partner visas, dependent children, or those switching from one visa category to another, while they are living in the UK.
