Who is Eligible to Apply for a Family Visa?

A Non-British individual can apply for a Family visa to come to join a person in the UK who is either a British National, has Indefinite Leave to remain, settled/pre-settled status or has asylum/humanitarian protection in the UK and come under any of the following categories:

  • A spouse or partner
  • A fiancé, fiancée or proposed civil partner
  • A child
  • A parent
  • A relative who requires long-term care



Spouse / Partner Visa

Partners (husbands, wives, civil partners, unmarried or same-sex partners) of British citizens and "settled" persons can apply to join their partner in the UK providing all of the requirements under Appendix FM of the immigration rules are satisfied, including:


  1. The Suitability Test Requirement; and
  2. The Eligibility Requirement, which includes the Relationship Requirement, the Financial Requirement and the Accommodation Requirement;
  3. The English Language Requirement; (if they are citizens of countries that are not exempted from meeting the English language requirement) and
  4. The Tuberculosis Test Requirement (if they are citizens of certain countries, as listed by the Home Office)


For unmarried partners, you and your partner must be in a relationship akin to a marriage, for a minimum period of 2 years.


After continuous residence of 5 years in the UK, you can apply to settle in the UK (with Indefinite Leave to Remain ) as the partner of a British citizen or settled person with application form SET(M).


Fiancé(e) / Proposed Civil Partner Visa

Fiancé(e)'s or proposed civil partners of British citizens and settled persons can apply to come to the UK for an initial period of 6 months.

You and your partner must intend to marry and live together permanently in the UK to be eligible.

Once you are married/have become civil partners, you can apply to remain in the UK as a spouse/civil partner via Form FLR (M).

Child Dependant Visa

Any children under the age of 18 of a parent/parents that are either British citizens, settled/pre-settled persons or persons who have been given permission to permanently reside in the UK are eligible to apply for a visa to join their parent in the UK. Other conditions that must be satisfied are that:

  • The child is not married/in a civil partnership or living an independent life (such as moved away home and has a family of their own)
  • The child must be financially supported without claiming public funding


Skilled / Health and Care Worker Visa Holders

Parent Visa

If you are a Parent of a Child (under the age of 18) that has British Citizenship, settled/pre-settled status or proof of permanent residence in UK, you can apply for a Visa to join them in the UK.

If you are already in the UK with limited leave, you can also apply to remain in the UK, if your child has lived in the UK continuously for 7 years and it would be deemed unreasonable for them to leave.


Additionally, you must have sole/shared responsibility of the child and prove that you will be taking an active role in their upbringing and will continue to do so after you apply.


* It should be noted that, if you are eligible to apply as a partner, you must apply as a partner instead of applying as a parent.


Adults coming to be cared for by a Relative in the UK

You can also apply to come to the UK on the basis that you are over 18 and need long term care from any of the following family members that have; British Citizenship, settled status or have been granted asylum or humanitarian protection in the UK:

 

  • parent
  • child
  • grandchild 
  • brother
  • sister

 

You must be able to prove that you require long-term care to carry out everyday tasks due to illness, disability or your age. Such care must also not be available/affordable in your own country. Also, the person who will be providing your care needs to be able to support and accommodate you without claiming public funds (for a minimum period of 5 years).


As an adult coming to be cared for by a family member in the UK, you will be able to stay indefinitely if your family member is a British national or is settled in the UK.

If your family member (sponsor) has refugee status/humanitarian protection which needs to be extended, you will have to apply to extend/settle when they do.
